Indonesia's AGO Says It Is Ready to Enforce the New KUHP and KUHAP

TEMPO.CO, Jakarta - The Indonesian government officially began enforcing its new Criminal Code (KUHP) and the Criminal Procedure Code (KUHAP) Law on Friday, January 2, 2026, marking a major overhaul of the country’s criminal justice framework. The Attorney General’s Office said it is fully prepared to implement the new legal regime.

“With the entry into force of the new KUHP and KUHAP, the Attorney General’s Office is ready to carry out Law No. 1 of 2023 on the Criminal Code and Law No. 20 of 2025 on the Criminal Procedure Law,” Anang Supriatna, head of the Attorney General’s Legal Information Center, said on Friday.

Anang said the Attorney General’s Office has coordinated closely with key institutions to ensure a smooth transition. These preparations are formalized through memorandums of understanding with the National Police, provincial and district governments, and the Supreme Court.

He added that prosecutors have undergone extensive technical preparations, including training sessions, focus group discussions, and joint technical programs aimed at strengthening institutional capacity under the new laws.

Indonesia’s House of Representatives (DPR) passed the new Criminal Code in 2023, while the Criminal Procedure Law was approved in mid-November 2025. Both laws came into force simultaneously on January 2, 2026.

However, lawmakers have acknowledged that additional implementing regulations are still needed. Habiburokhman, chairman of the DPR’s Commission III, which oversees legal affairs, said discussions on derivative legislation would continue.

“Next week, we will discuss the Punishment Adjustment Law,” he said on November 19, 2025.

Meanwhile, Law and Human Rights Minister Supratman Andi Agtas said the adoption of the new Criminal Procedure Law has strengthened the readiness of Indonesia’s criminal justice system.

“With the new KUHP now in force on January 2, 2026, the KUHAP is also fully prepared to support its implementation,” he said.
