
TEMPO.CO, Jakarta - The Constitutional Court will summon President Prabowo Subianto and the Indonesian House of Representatives (DPR) this month to provide explanations in relation to the formal review of the Indonesian National Armed Forces Law (TNI Law) and the State-Owned Enterprises Law (BUMN Law).
Tempo has obtained documents showing that the panel of judges decided during a deliberation meeting (RPH) to hold a plenary session for the formal review of Law No. 34 of 2004 on the Indonesian National Military under Case No. 45/PUU-XXIII/2025 on June 23, 2025.
The RPH also scheduled a separate plenary session for the formal review of Law No. 1 of 2025 on State-Owned Enterprises for June 24, 2025.
The documents state that the sessions will include hearing statements from both the President and the House of Representatives. When contacted for confirmation, Constitutional Judge Saldi Isra acknowledged the summons. He explained that under Article 54 of Law No. 24 of 2003 on the Constitutional Court, the Court may request statements or meeting minutes relevant to the ongoing cases from the People's Consultative Assembly, the House of Representatives, the Regional Representative Council, and the President.
"Not as witnesses, but to provide statements. There is no obligation mentioned in Article 54 of the Constitutional Court Law," Saldi told Tempo on June 11, 2025.
Saldi also said the House of Representatives may delegate any of its internal bodies to represent the institution and deliver its statement at the plenary session.
Earlier, the Constitutional Court ruled that five out of ten petitions for formal and material review of the TNI Law would move forward to the evidentiary stage. Constitutional Judge Suhartoyo noted that these five cases include Case Nos. 45, 56, 69, 75, and 81/PUU-XXIII/2025, which were filed by university students and a civil society coalition.
"The cases are being brought to a follow-up plenary session to hear statements from the government and the House of Representatives," Suhartoyo said while delivering the ruling on Thursday, June 5, 2025.
He added that these five cases will be heard on June 23, 2025, and urged the government and the House to prepare the necessary materials related to the petitions.
Regarding the State-Owned Enterprises Law, the formal review was filed by two University of Indonesia students on April 8, 2025. The students challenged Law No. 1 of 2025, which served as the legal basis for establishing Danantara.
They argued that the law caused constitutional harm and was passed without sufficient public participation, which they claim violated the principle of meaningful involvement in the legislative process.
