TEMPO.CO, Jakarta - International Criminal Court (ICC) judges on Wednesday, July 17, 2025, rejected Israel's request to withdraw the arrest warrants for Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. The ICC also reviewed Israel's challenge to its jurisdiction over the Gaza operation.
According to Arab News, a decision published on the ICC's website shows that the judges also denied Israel's request to suspend the broader ICC investigation into alleged crimes in the Palestinian territories.
The ICC initially issued arrest warrants on November 21, 2024, for both Netanyahu and Gallant, as well as for Hamas leader Ibrahim al-Masri, for alleged war crimes and crimes against humanity during the Gaza conflict.
However, in February 2025, the court announced that judges had revoked the arrest warrant for al-Masri, also known as Mohammed Deif, following credible reports of his death.
Israel disputed the jurisdiction of the Hague-based court and denied committing war crimes in Gaza, where it launched a military campaign. Consequently, Israel challenged the arrest warrants for Netanyahu and Gallant.
Israel argued that an April ruling by the appeals chamber, which ordered a pre-trial chamber to review Israel's objection to the court's jurisdiction, meant there was no valid basis for the existing arrest warrants.
The judges, however, rejected these claims as unfounded. They stated on Wednesday that Israel's jurisdiction challenge against the arrest warrants remains pending. Therefore, the warrants will stay in effect until the court makes a specific decision on that matter. There is no set time limit for a jurisdiction decision in this case.
In June, the United States imposed sanctions on four ICC judges. Two of these sanctioned judges were part of the panel that decided to reject Israel's request to withdraw the arrest warrants.
