TEMPO.CO, Jakarta – The Military Prosecutor II-07 Jakarta on Thursday transferred the case file of Andrie Yunus to the Military Court II-08 Jakarta for trial proceedings. The handover follows the submission of case files involving four Indonesian Military (TNI) soldiers from the Military Police investigation.
Head of Military Prosecutor II-07 Jakarta, Colonel of the Legal Corps (Chk) Andri Wijaya, said the alleged motive behind the acid attack was personal.
“Based on the examination report so far, the motive of the defendants is still a personal vendetta against Mr. AY,” he said at a press conference at the Military Court II-08 Jakarta on Thursday.
Based on information from the Indonesian Military Police, four suspects, namely NDP, SL, BHW, and ES, have been named. The suspects are personnel from the Air Force and Navy assigned to the Strategic Intelligence Agency.
NDP holds the rank of captain, while SL and BHW are first lieutenants, and ES is a second sergeant.
The number of suspects differs from findings by the Advocacy Team for Democracy, the legal team of Andrie Yunus, which suspects up to 16 field operatives were involved.
TAUD representative Alghiffari Aqsa said this assessment was based on internal findings supported by analysis of footage from 37 CCTV cameras around the Salemba intersection in Central Jakarta.
Responding to the findings, Andri said prosecutors are open to further examination if other parties are proven to be involved in court. However, he stressed that the ongoing legal process will continue.
“If there are civilians involved, they will be handled separately. This is in accordance with procedural law and Supreme Court SOPs, and the process must continue accordingly,” he said.
In this case, the Military Prosecutor II-07 Jakarta will charge the suspects with multiple articles under Indonesia’s Criminal Code. These include Article 469 paragraph (1) in conjunction with Article 20 letter (c), Article 468 paragraph (1) in conjunction with Article 20 letter (c), and Article 467 paragraphs (1) and (2) in conjunction with Article 20 letter (c).
Article 468 paragraph (1) covers assault causing serious injury, carrying a maximum penalty of eight years in prison. Article 467 paragraphs (1) and (2) regulate premeditated assault, with penalties of up to four years in paragraph (1), and up to seven years if it results in serious injury under paragraph (2).
