Why TikTok Refuses to Be Regulated in Indonesia's Broadcasting Bill

TEMPO.CO, JakartaTikTok Indonesia rejects the plan to regulate digital platforms in the Revised Broadcasting Law (RUU). TikTok Indonesia's Head of Public Policy and Government Relations, Hilmi Adrianto, stated that digital platforms based on user-generated content (UGC) like TikTok are already regulated within a content moderation framework under the supervision of the Ministry of Communication and Digital.

Therefore, they are requesting that Commission I of the House of Representatives (DPR) not be regulated by the same regulations as conventional broadcasters. "We recommend that UGC platforms not be regulated under the same regulations as conventional broadcasters to avoid legal uncertainty," Hilmi said during a public hearing with Commission I of the DPR in Senayan, Jakarta, on Tuesday, July 15, 2025.

TikTok Indonesia recommends that UGC platforms remain regulated within the existing moderation framework under the supervision of the Ministry of Communication and Digital. They do not recommend a one-size-fits-all regulatory approach for conventional broadcasters, OTT services, and UGC platforms.

"Because each has a fundamentally different business model and content governance framework," Hilmi said.

He explained that platforms like TikTok are UGC platforms where user-generated content forms the basis of TikTok's content. He emphasized the significant differences between UGC and traditional broadcasting institutions.

First, in terms of content creation and control, UGC platforms like TikTok create and upload content by individual users and businesses. "In contrast, traditional broadcasters and OTT platforms provide content produced or uploaded directly by the platform," Hilmi said.

Furthermore, in terms of business model and user participation, UGC platforms are driven by active user participation and open access for the public, MSMEs, and creators. Meanwhile, traditional broadcasters focus on passive construction with access limited to professional content producers and licensees.

TikTok Indonesia also emphasized the differences in content volume and oversight. On UGC platforms like TikTok, any amount of content can be uploaded by users at any time, and violating content is proactively detected and removed through a rigorous moderation process using a combination of technology and human resources.

Traditional broadcasters, on the other hand, have a limited, scheduled, and curated content. Therefore, content moderation can be carried out curatively because all material can be reviewed, edited, and approved before being broadcast to the public.

Currently, Commission I of the House of Representatives (DPR) is gathering input to revise regulations through the Working Committee (Panja) for the Revision of Law Number 32 of 2002 concerning Broadcasting. Commission I member Amelia Anggraini stated that the Broadcasting Bill is an urgent need amidst the lengthy legislative process.

Therefore, she stated that the regulation of digital platform broadcasting can be temporarily combined with conventional broadcasting within the Broadcasting Bill.

"Why we are coming up with this, it must be done together with the Broadcasting Law and content? Because it can be regulated in a PP (government regulation), a Permen (ministerial regulation), or can be regulated through a rigid mechanism," Amelia said in the meeting.

She emphasized that by definition, the substance remains the same. Everything broadcast or published falls within the definition of broadcasting. "One is from the internet, the other is from transmission. The method is different, but the definition of broadcasting is the same," Amelia explained.
