Nadiem Makarim on 10-Year Sentence: 'Does Justice Still Matter?'

TEMPO.CO, Jakarta - The Indonesian court has sentenced former Minister of Education, Culture, Research, and Technology, Nadiem Makarim, to 10 years in prison for corruption involving Chromebook procurement. Nadiem spoke out, stating that the ruling was based on unreasonable facts.

"Today, we are asking a big question of our legal system. Do truth and justice still matter? Today, it has been answered; all the court facts were ignored," the minister who served from 2019 to 2024 told reporters after his decision hearing at the Corruption Court in Jakarta on Tuesday, June 30.

According to Nadiem, he listened to the judges attentively during his sentencing, but the four judges "avoided my gaze," he said.

Nadiem Makarim said he knew that the judges understood his innocence in the case, which was marked by one courageous judge who laid out the truth. "There was one dissenting opinion, Judge Andi, who spoke of the truth frankly and said I should be released unconditionally," he said.

Nadiem was found guilty in the alleged corruption case involving the digitalization of the education program through Chromebook laptops and Chrome Device Management (CDM) procurements within the education ministry from 2019 to 2022.

The former minister was sentenced to 10 years in prison and a Rp1 billion fine, or 190 days in prison, and restitution of Rp809.59 billion, or 5 years in prison.

Nadiem was ordered to pay the restitution after being found guilty of receiving Rp809.59 billion from PT Aplikasi Karya Anak Bangsa (PT AKAB) through PT Gojek Indonesia.

It was stated that the majority of PT AKAB's funds came from a US$786.99 million investment from Google.

In this case, Nadiem was found guilty of abuse of authority, which caused Rp1.56 trillion in state losses.

The alleged corruption involved, among other things, the procurement of information and communication technology-based learning facilities, including Chromebook laptops and CDMs, for the 2020, 2021, and 2022 fiscal years, in violation of procurement planning and principles.

Nadiem Makarim allegedly carried out his crime in collaboration with three other defendants who were convicted in separate trials: Ibrahim Arief, Mulyatsyah, and Sri Wahyuningsih; and Jurist Tan, who remains a fugitive.

Nadiem was found guilty of violating Article 3 in conjunction with Article 18 of the Corruption Law Number 31 of 1999, as amended and supplemented by Law Number 20 of 2001, in conjunction with Article 55 paragraph (1) point 1 of the Criminal Code.
